Statement of Alleged Misconduct and Legal Violations

Based on sworn depositions, court transcripts, law enforcement reports, and professional evaluations filed in Cause No. 13-06713-T, there is substantial evidence of coordinated misconduct resulting in the alienation of a child from a fit and willing parent, the obstruction of justice, and the violation of state and federal law.

The following Texas laws appear to have been violated:

  • Texas Penal Code § 37.02 – Perjury
  • Texas Penal Code § 37.09 – Tampering with or Fabricating Physical Evidence
  • Texas Penal Code § 42.06 – Filing False Police Reports
  • Texas Penal Code § 25.03 – Interference with Child Custody
  • Texas Penal Code § 22.04 – Injury to a Child (Emotional Abuse)
  • Texas Family Code § 153.001 – Violation of the Best Interest of the Child Standard
  • Texas Code of Judicial Conduct Canon 3(B) – Judicial Misconduct and Abuse of Discretion
  • Texas Disciplinary Rules of Professional Conduct Rule 1.01(b)(1) – Neglect of Legal Matter
  • Texas Administrative Code § 681.41 / § 681.42 – Mental Health Ethics Violations
  • Texas Health & Safety Code § 611.002 – Improper Disclosure of Mental Health Records

The following federal statutes may also apply based on the documented actions:

  • 18 U.S.C. § 241 – Conspiracy Against Rights
  • 18 U.S.C. § 242 – Deprivation of Rights Under Color of Law
  • 18 U.S.C. § 1503 – Obstruction of Justice
  • 18 U.S.C. § 1341 / § 1343 – Mail and Wire Fraud
  • 18 U.S.C. § 1962 – Racketeer Influenced and Corrupt Organizations Act (RICO)

The collective impact of these actions has led to the unconstitutional severance of a parental relationship, the suppression of exculpatory evidence, and emotional harm to a minor child. All documentation is being submitted to the appropriate state and federal oversight bodies, including the State Bar of Texas, Dallas County District Attorney, Texas Attorney General, and the Federal Bureau of Investigation.
